Overview

This Refund Policy explains when and how you can receive a refund for tickets purchased through the THECLUBISDEAD mobile application.

Important: THECLUBISDEAD operates as a disclosed agent. Event organizers are the sellers of tickets—we facilitate the transaction. Refunds are processed through our platform but are funded by the event organizer.

1. When You ARE Entitled to a Refund

1.1 Event Cancellation

If an event is cancelled by the organizer:

  • You receive a full refund (ticket price + booking fees)
  • Refunds are processed automatically within 5-10 business days
  • Refunds return to your original payment method
  • You will receive email confirmation

No action required—refunds are automatic when an event is cancelled.

1.2 Force Majeure Cancellations

If cancelled due to government orders, natural disasters, severe weather, pandemics, venue emergencies, or acts of terrorism, you still receive a full refund.

1.3 Significant Event Changes

Our platform operates on a strict no-changes policy. If an organizer needs to change date, time, or venue, the event must be cancelled with full refunds. A new event with updated details may be created.


2. When You Are NOT Entitled to a Refund

2.1 Change of Mind

Event tickets are exempt from cooling-off period rights under consumer protection laws (UK Consumer Rights Act 2015, EU Consumer Rights Directive, US state laws) because they are leisure services on a specific date.

No refund if:

  • You change your mind about attending
  • Your plans change
  • You find a better price elsewhere

2.2 Purchasing Errors

No refund if:

  • You purchased tickets for the wrong date
  • You purchased the wrong ticket type
  • You purchased more tickets than intended
  • You did not read event details carefully

Please review your order before completing purchase. All sales are final.

2.3 Entry Refusal Due to Your Conduct

No refund if refused entry due to:

  • Failure to present valid ID
  • Failure to meet age requirements
  • Intoxication or disruptive behavior
  • Violating venue or event rules
  • Failure to meet dress code
  • Failure to pass security checks

2.4 Event Experience

No refund for:

  • Events that did not meet expectations
  • Perceived poor quality
  • Performer changes
  • Event duration shorter than expected
  • Venue conditions
  • Crowding or long queues

We are a ticketing platform, not the event organizer. Recourse for event issues is with the organizer directly.

2.5 Ticket Transfer Issues

No refund if:

  • You transferred your ticket and want it back
  • Someone you transferred to cannot attend
  • A transferred ticket was used by someone else

Transfers are final.


3. Special Circumstances

3.1 Refused Entry (Not Your Fault)

If refused entry through no fault of your own (oversold event, venue error), contact us immediately at support@theclubisdead.com with:

  • Order confirmation number
  • Details of what happened
  • Any communication with venue staff

We will investigate with the organizer. Refunds in these cases are case-by-case.

3.2 Duplicate Purchases

If you accidentally purchased tickets twice, contact us within 24 hours at support@theclubisdead.com. We may issue a refund at our discretion.

3.3 Fraudulent Transactions

If you believe a purchase was made fraudulently:

  1. Contact your bank immediately
  2. Contact us at support@theclubisdead.com
  3. Provide bank reference numbers

Refunds for fraud are subject to bank and payment processor procedures.


4. How Refunds Are Processed

4.1 Automatic Refunds (Event Cancellation)

  1. All tickets are automatically refunded
  2. Email notification sent
  3. Funds return to original payment method
  4. Processing time: 5-10 business days

4.2 Refund Method

  • Refunds return to original payment method
  • Credit/debit card: 5-10 business days
  • Apple Pay/Google Pay: 5-10 business days

4.3 Partial Refunds

If you purchased multiple tickets and some are eligible for refund, only eligible tickets are refunded. Non-eligible tickets remain valid.


5. Credit Notes

When a refund is processed, you receive:

  1. Ticket Sales Credit Note - From the event organizer
  2. Booking Fees Credit Note - From THECLUBISDEAD

These are sent to your email for record-keeping.


6. Your Rights

6.1 UK Customers

Under the Consumer Rights Act 2015:

  • Right to refund if event is cancelled
  • Right to refund if services not provided as described
  • The exemption from 14-day cooling-off for event tickets is permitted under Schedule 2 of the Consumer Contracts Regulations 2013

6.2 EU Customers

Under the EU Consumer Rights Directive:

  • Right to refund if event is cancelled
  • The exemption from cooling-off for leisure services on a specific date applies

6.3 US Customers

Consumer protection varies by state. Generally, event tickets are non-refundable unless cancelled.
